ONLINE STORE REGULATIONS

Below we are presenting document defining rules of sale (hereinafter referred to as the regulations) and conditions which are subject in usage of our online store (WWW.DRYANLABS.COM) and making purchases through it.

The owner of the online store is DR YAN LABS limited liability company with headquarters in Poznań (60-539), St. Św. Wawrzyńca 1a/1, entered in the register of entrepreneurs in the National Court Register in Poznań, 8th Commercial Division of the National Court Register under KRS number 0001093821, REGON number 528057617, NIP number 7812067104.




2. DEFINITIONS

Terms used in the regulations means:


2.1 Consumer - means any natural person who makes an act with the trader legal entity which is not directly related to its business or professional activity.

2.2 Customer - a natural person, legal person or organisational unit without legal personality, which is granted legal capacity by special regulations, placing an Order in the Store.

2.3 Account - regulated by separate regulations, a free-of-charge store function, in which the Customer, after registering and logging in, may: place orders for Goods, view the history of previous purchases, have access to his personal data and make changes to them.

2.4 Regulations - these Regulations for the provision of electronic services in the online store www.blackmariaoils.com. These Regulations are Regulations within the meaning of the Act of 18 July 2002 on the provision of electronic services (consolidated text. Journal of Laws of 2020, item 344).

2.5 Seller - DR YAN LABS LLC with its registered office in Poznań (60-539), ul. Św. Wawrzyńca 1a/1, entered into the Register of Entrepreneurs of the National Court Register in Poznań, 8th Commercial Division of the National Court Register under KRS number 0001093821, REGON number 528057617, NIP number 7812067104.

2.6 Civil Code - the Act of 23 April 1964 - Civil Code (consolidated text. Journal of Laws 2019, item 1145, as amended).

2.7 Goods (or Product) - all products available in our online store, which are subject to a Sales Agreement.

2.8 Internet shop (Store) - an Internet service available at www.dryanlabs.com, where the customer may place orders.

2.9 Order - Customer's declaration of will, aiming directly at concluding a Sales Agreement, specifying in particular the type and quantity of Goods.

2.10 Sales contract - a contract of sale of Goods, as defined by the Civil Code, concluded between (company) and Client, concluded with the use of the Store's website.

2.11 Consumer Rights Act - the Consumer Rights Act of 30 May 2014 (i.e. dated 9 March 2017, Journal of Laws 2017, item 683 as amended).

2.12 Act on provision of services by electronic means - Act of 18 July 2002 on provision of services by electronic means (i.e. of 9 June 2017, Journal of Laws of 2017, item 1219 as amended).

2.13 Data Protection Act - the Act of 10 May 2018 on the protection of personal data (Journal of Laws of 2018, item 1000).

2.14 Code of Civil Procedure - the Act of 17 November 1964 Code of Civil Procedure (i.e. 14 June 2018, Journal of Laws 2018, item 1360 as amended).


3. GENERAL PROVISIONS

3.1 These Regulations set out the rules for using the Online Store available at www.dryanlabs.com

3.2 These Regulations are the regulations referred to in Article 8 of the Act on Rendering Electronic Services.

3.3 The online store, operating at www.dryanlabs.com is operated by the Seller.

3.4 These rules and regulations set out in particular:

  1. the rules of placing Orders at the Online Store by electronic means;
  2. principles of concluding Sales Agreements concerning the services provided by the Internet Store;
  3. principles of operation of Newsletter and Account;

3.5 Customers may access these Terms and Conditions at any time via the link located at the bottom of the main page of the Online Store at www.dryanlabs.com.


4. RULES OF USE OF THE WEB SHOP

4.1 Purchase of Goods and use of the online store is possible for persons who have the capacity to enter into a binding contract.

4.2 The Seller may deprive the Client of the right to use the Online Store, and may also restrict the Client's access to some or all of the Online Store's resources, with immediate effect, in case of violation of the Terms and Conditions by the Client, and in particular in case the Client:

  1. provided during registration in the online store data that is untrue, inaccurate or outdated, misleading or violating the rights of third parties;
  2. commits other behaviour inconsistent with applicable law or general rules of using the Internet, or harming the good name of the Seller;

4.3 In order to ensure the security of transmission of messages and data in connection with the services provided by the Online Store, the Seller shall take technical and organisational measures appropriate to the level of security risk of the services provided, in particular measures to prevent unauthorised collection and unauthorised modification of personal data transmitted online.

4.4 Personal data entered by the Customer in the Online Store are processed in accordance with all regulations governing the processing of personal data, including in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (Dz.Urz.UE.L No. 119, p. 1), and the Act of 10 May 2018 on the protection of personal data (Dz.U. of 2018, item 1000).



4.5 In particular, the customer is obliged to:

  1. not to provide or transmit content that is prohibited by law, e.g. content that promotes violence, defames or violates personal rights and other rights of third parties;
  2. use the Online Store in a manner consistent with the provisions of applicable law in the Republic of Poland, the provisions of the Terms of Use, as well as with the general principles of using the Internet;
  3. use the Online Store in a manner that does not disrupt its operation, in particular through the use of specific software or devices;
  4. not to take actions such as: sending or placing within the scope of the Internet Shop unsolicited commercial information (spam);
  5. the Seller uses cookies on its website.  The Customer may specify the conditions for storing or accessing cookies in the Customer's web browser.  Information about cookies is included in our Privacy Policy;


5. PROCEDURE FOR CONCLUDING THE SALES AGREEMENT

5.1 To place an Order at the Online Store and to conclude the Sales Agreement it is necessary to select Goods from the current Seller's offer.  The choice is made by clicking on the link to the Product and then the "ADD TO CART" button.  After clicking the link to the Shopping Cart, a summary of the selected Goods will be presented.

5.2 You can place an Order by clicking on the "Proceed to Checkout" button.

5.3 Then carefully enter your personal information according to the form field names.  At this stage the Customer may choose to register at www.dryanlabs.com by selecting the appropriate option and entering a password.

5.4 It is also necessary to choose the form of payment by selecting the appropriate option, as well as to express acceptance for the rules of the Online Store and consent to the processing of personal data.

5.5 Clicking the "Buy and pay" button is the final confirmation of the Order, and the data entered and choices made will no longer be subject to modification.

5.6 Sending an Order by the Customer constitutes a statement of will to conclude a Sales Agreement with the Seller, in accordance with its content and the content of the Terms and Conditions.

5.7 After placing an Order, the Customer receives a confirmation e-mail containing the final confirmation of all important elements of the Order.

5.8 The Agreement shall be deemed concluded at the moment the Customer receives the e-mail message referred to above.

5.9 The sales agreement is concluded in Polish and its provisions are consistent with the Order and the Regulations.

5.10 Making a purchase at www.dryanlabs.com is equivalent to accepting the regulations and privacy policy.

6. ACCOUNT

6.1 The Customer may create an Account on the Store's website.  The creation of an Account is voluntary and free of charge.

6.2 In order to set up an Account, the Customer completes the registration form made available by the Seller on the Store's website at https://dryanlabs.com/moje-konto/ and sends the completed registration form electronically to the Seller by clicking on the "REGISTER" button.  During the registration the customer sets an individual password.  Before creating an account, you must read and accept the Terms of Service and the Privacy Policy.

6.3 After sending the completed registration form to the Seller, the Customer receives a confirmation e-mail that contains all relevant information about the Account.

6.4 The agreement for provision of the Customer's Account service by electronic means shall be deemed concluded upon receipt by the Customer of the confirmation e-mail referred to above.

6.5 The Customer may delete his/her Account at any time by sending a request to info@dryanlabs.com.

6.6 Seller shall have the right to delete the Account, including removing all data contained therein, at any time, for any reason, with or without prior notice to Customer.

6.7 The Seller may deactivate the Account at any time if it becomes convinced that the Customer does not comply with any of the provisions of the Terms and Conditions.


7. DELIVERY

7.1 Domestic shipping in Poland.

7.2 The cost of delivery will be indicated at the time of placing the Order.

7.3 DPD or InPost shipping from 1 to 3 working days after receiving payment from the Buyer.

7.4 Fixing, securing, making available and confirming to the Client the material provisions of the Goods Sales Agreement shall take place by sending to the Client at the provided e-mail address confirmation and specification of the Order.


8. PRICES AND METHODS OF PAYMENT

8.1 Prices of Goods are given in Polish zloty (PLN) and include VAT (specifying the rate), but do not include delivery costs, which are payable additionally and are specified in the course of the transaction.

8.2 The customer has the following payment options: Mollie (P24) / Stripe (Credit and debit cards) / Traditional bank transfer.



9. RIGHT OF WITHDRAWAL

9.1 The Customer shall have the right to withdraw from the Goods Sales Contract within 14 days without giving any reason.  The period to withdraw from the contract expires after 14 days from the day on which the Customer has gained possession of the goods or in which a third party other than the carrier and indicated by the Customer has gained possession of the goods.  In order to exercise the right of withdrawal, the Customer must inform the Seller by e-mail to the address info@dryanlabs.com about his decision to withdraw from the Sales Agreement by making an unequivocal statement.

9.2 The statement of withdrawal may also be submitted by mail using the form included in Appendix 2 to the Act on Consumer Rights.  In order to meet the deadline for withdrawal from the Sales Agreement, it is sufficient for the Customer to send information on exercising his/her right to withdraw from the Sales Agreement before the expiry of the deadline for withdrawal.

9.3 In the case of withdrawal from the Sales Agreement, the Seller shall return to the Client all payments received, including the costs of delivery of the Goods (except for additional costs resulting from the selection by the Client of a method other than the cheapest standard method of delivery offered by the Seller), immediately, and in any case not later than within 14 days from the date on which the notice of withdrawal from the Sales Agreement has reached the Seller.

9.4 The Seller will refund the payment using the same means of payment that were used by the Customer in the original transaction, unless the Customer expressly agrees to a different solution;  in any case, the Customer shall not incur any fees in connection with the return of the payment.

9.5 The Client shall be obliged to return the Goods to the Seller no later than within 14 days from the date of withdrawal from the Sales Agreement. In order to meet the deadline it is enough to send back the Goods before the deadline.  The Customer shall only bear the direct costs of returning the Goods.


10. COMPLAINTS ABOUT GOODS

10.1 The Seller shall be obliged to deliver Goods that are consistent with the Sales Agreement and free from defects.

10.2 The Seller shall be liable to the Customer who is a consumer within the meaning of Article 22 [1] of the Civil Code under the warranty for defects to the extent defined in the Civil Code, in particular Article 556 and Article 556[1] - 556[3] of the Civil Code.

10.3 If the Consumer claims that any of the Products delivered are defective, the Consumer has the right to make a complaint.  The Customer must send back to the Seller the Product that is defective according to him at his own expense.

10.4 Complaints arising from violation of the Client's rights guaranteed by law or under these Terms and Conditions should be addressed to info@dryanlabs.com. The Seller undertakes to consider each complaint within 14 days, and if this is not possible, to inform the Client when the complaint will be considered.



11. PROCESSING OF PERSONAL DATA

11.1 Personal data provided by the Customer in the Online Shop are processed in accordance with all regulations governing the processing of personal data, including in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) (Official Journal of the European Union No. 119, p. 1, as amended) and the Act of 10 May 2018 on the protection of personal data (consolidated text  Journal of Laws 2019, item 1781).  Details of the processing of personal data can be found in the Privacy Policy available on this website.


12. COMPLAINTS CONCERNING THE PROVISION OF SERVICES BY ELECTRONIC MEANS

12.1 The Seller takes actions to ensure fully proper functioning of the Online Store, to the extent resulting from the current technical knowledge, and undertakes to remove all irregularities reported by the Clients within a reasonable time.

12.2 The Customer should immediately notify the Seller of any irregularities or disruptions in the functioning of the Online Store website.

12.3 Any irregularities related to the functioning of the Store should be reported by the Customer via e-mail to info@dryanlabs.com

12.4 In a complaint, the Customer should provide his or her name, correspondence address, type and date of irregularity related to the functioning of the Store.

12.5 The Seller undertakes to consider each complaint within 14 days, and if this proves impossible, to inform the Customer within this period when the complaint will be considered.


13. NEWSLETTER TERMS AND CONDITIONS

13.1 In the case of consent for processing of personal data provided in the form on the website www.dryanlabs.com for marketing purposes of the Seller, including in particular the receipt of commercial information by e-mail (e.g. in the form of Newsletter) or by phone, the Client will receive a service consisting in periodic transmission of information in the form of an electronic letter (e-mail), hereinafter referred to as "Newsletter", to the e-mail address provided by the Client.  The Newsletter service is free of charge, for an indefinite period of time.

13.2 Newsletter contains information about the Seller's product offer, news, current promotions and other information about the Seller and his products, including opinions, press materials, links to friendly websites.

13.3 The Customer may at any time, without giving reasons and without incurring costs, change the previously indicated e-mail address to which the Newsletter is sent or resign from this service by sending an appropriate request to the Seller at the e-mail address info@dryanlabs.com

13.4 Complaints related to the Newsletter service should be sent by e-mail to the following address: info@dryanlabs.com

13.5 The complaint should contain the name, surname, e-mail address of the Customer, description of the subject of the complaint, including specification of the demand and its justification, and the signature of the person submitting the complaint.

13.6 Complaints will be processed within 14 days of their receipt by the Seller.  The Seller shall immediately notify the complainant of the decision on the complaint via e-mail to the e-mail address provided in the complaint.


14. FINAL PROVISIONS

14.1 Sales agreements concluded on the basis of these Regulations shall be governed by Polish law.

14.2 Settlement of any disputes arising between the Seller and the Customer, who is a consumer within the meaning of Article 22[1] of the Civil Code, shall be submitted to the competent courts in accordance with the provisions of the relevant provisions of the Civil Procedure Code.

14.3 Settlement of potential disputes arising between the Seller and the Customer, who is not a consumer within the meaning of Article 22[1] of the Civil Code, shall be submitted to the court having jurisdiction over the Seller's registered office.

14.4 Any disputes arising between the Seller and a Customer who is not a Consumer shall be settled exclusively by Polish courts.

14.5 All intellectual property rights to the Products belong to the Seller.  All such rights are reserved.

14.6 The exclusive right to the content made available via the Online Store, in particular copyright, the name of the Online Store, Seller's trademarks, their graphics, software and database rights are owned by the Seller and are subject to appropriate protection.

14.7 The Seller shall inform the Customer who is the Consumer about the possibility of using out-of-court complaint and claim procedure.  The rules of access to these procedures are available at the registered offices or on the websites of the entities authorised to settle disputes out of court.  They may be, in particular, consumer ombudsmen or Voivodeship Inspectorates of Trade Inspection, the list of which is available on the website of the Office of Competition and Consumer Protection at http://www.uokik.gov.pl/spory_konsumenckie.php.

14.8 The Seller informs that on the website at http://ec.europa.eu/consumers/odr/ a platform for online dispute resolution between consumers and traders at EU level is available (ODR platform - online dispute resolution).

14.9 In matters not covered by these Terms and Conditions, the provisions of the Civil Code, the Consumer Rights Act, the Act on Provision of Electronic Services and other relevant provisions of Polish law shall apply.

14.10 These regulations are effective as of April 01, 2024.
